ARTICLE 1: LEGAL STATUS
Le Ramoneur de Séglien is a self-employed company subject to VAT. Intracommunity VAT number : FR 65929802668.
ARTICLE 2: CIVIL LIABILITY INSURANCE
The company is insured for professional civil liability with MAAF under contract number : 156199381 G - MCE - 001.
ARTICLE 3: LIMITS OF LIABILITY
1. Compliance obligation
- Customers must ensure that their installations comply with current standards (NF DTU 24.1 and 24.2).
- Any non-compliance found will be reported, and no chimney sweeping certificate will be issued if the installation is deemed to be dangerous or out of standard.
- It is the customer's responsibility to comply with the maintenance and inspection frequencies imposed by law, in particular those of the Decree no. 2023-641 and Standard Departmental Health Regulations (RSDT).
- The company accepts no responsibility if the installation has been modified or repaired by an unqualified or unlicensed person.
- If the waterproofing is not inspected periodically (every 3 years - NF DTU 24.11 P1, art. 14.6 and appendix C), the company cannot be held responsible for any subsequent waterproofing defects.
2. Intervention on specific equipment
- Pellet stoves : intervention is limited to cleaning the flue. Restarting and adjustments must be carried out by an authorised technician.
- Oil or gas boilers : restarting must be carried out by a qualified heating engineer.
3. Liability for cracks or damage
The company accepts no responsibility for cracks or breakage in the refractory boards (vermiculite, chamotte) used for chimney sweeping.
3 bis. Intervention supplements
- A surcharge of between 0 and 20 € may be applied depending on the complexity of removing/reassembling the deflectors.
- A supplement of €70 is charged for Mass production stoves (PDM).
4. Elements not visible or inaccessible
- No diagnosis can be carried out on parts that are not visible or inaccessible. The customer must guarantee their accessibility.
- If access is refused, the company cannot be held responsible.
- In accordance with Decree no. 2023-641 of 20 July 2023, In addition, the professional is obliged to check the condition of the stumps and accessories (caps, bolsters, hoovers, etc.).
- Chimney sweeping must ensure that there is sufficient draught and that the combustion air supply is not obstructed.
- In the event of damaged, incorrectly installed or non-compliant pipework, the work may be refused and a fee may be charged. fault report will be given to the customer.
5. Cleanliness of the premises
- The company makes every effort to limit dust, but some deposits (soot, bistre, cullet) may persist.
- The customer must protect sensitive areas around the work site.
- Deposits may occur on porous materials (stone, rendering, untreated wood). The company cannot be held responsible for persistent stains.
6. Casing and finishing
- If the required components (collar, cap, etc.) are missing, sweeping may be impossible or risky.
- Anti-volatile grilles are not recommended because they interfere with the draught. The company may refuse to carry out the work if a risk is identified.
- A rain cap that complies with standards is recommended.
7. Moss removal from roofs
- The aim of the treatment is to eliminate moss and lichen, not to guarantee an aesthetic result.
- The results depend on the condition of the roof. Subsequent seepage is not the responsibility of the contractor.
- A second pass may be offered within 12 months, charged at 50 % of the initial rate.
- It is advisable to check gutters and drains after work has been carried out.
8. Force majeure
The company cannot be held responsible for delays or non-performance in the event of force majeure (bad weather, vehicle breakdown, health problems, etc.).
ARTICLE 4: CANCELLATION POLICY
- Cancellation within 24 hours: 50 % of the invoiced amount.
- Same-day cancellation or unjustified absence: 100 % charged.
- Non-compliant installation: €35 for removal and “generator not swept” certificate.
ARTICLE 5: SWEEPING METHODS AND CONDITIONS
1. Preferred method
Chimney sweeping is carried out from below as far as possible, for reasons of safety and cleanliness. If this is not possible, soot removal from above may be considered, depending on access conditions and technical compliance.
2. Conditions for refusal
The company reserves the right to refuse any work that is unsafe, non-compliant or imposed from above without technical justification.
3. Before and after precautions
- The customer must ensure that the appliance is switched off and cold.
- The space around the fireplace must be kept clear.
- A visual vacuity test is carried out at the end of the procedure.
4. Customer's obligation
- Guarantee secure access.
- Comply with legal frequency requirements (Decree 2023-641 and RSDT).
ARTICLE 6: CHIMNEY SWEEPING CERTIFICATE
At the end of each session, a chimney sweeping certificate is given to the customer within fifteen working days. This document is required by insurance companies in the event of a claim.
ARTICLE 7: PAYMENT TERMS
- Payments accepted: cash, cheque, bank transfer.
- Maximum term: 30 days from date of invoice.
- Late payment penalties: 10 % of the amount due + fixed penalty of €40 (article L441-10 of the French Commercial Code).
ARTICLE 8: IMAGE RIGHTS
- Photographs taken during the operation may be stored for evidence purposes and used for company communications (website, social networks).
- The customer may object to this at any time by simple written request.
- Images are kept for a maximum of 5 years, unless required by law or expert appraisal.
ARTICLE 9: DISPUTES AND MEDIATION
1. Amicable settlement
In the event of a dispute, the customer is invited to contact the company to find an amicable solution (by post or email with supporting documents).
2. Mediation
In accordance with Article L.612-1 of the French Consumer Code, the customer may have free recourse to a mediator via the European platform : https://ec.europa.eu/consumers/odr.
3. Legal action
Failing agreement, any dispute will be referred to the Lorient court. The applicable law is French law.
ARTICLE 10: FINAL PROVISIONS
- If one clause is deemed invalid, the others remain valid.
- Acceptance of these General Terms and Conditions takes effect as soon as an appointment is confirmed or a quotation is signed.
